AltusHost provides Internet Presence services to a global market of customers. As such, we have certain legal and ethical responsibilities consisting with the use of our servers and equipment involved in providing these services. To ensure each of our customers receives the quality of service that is being paid for, we have to maintain several policies. All customers are obligated to read, agree to, and keep up-to-date on each of our policies. By obtaining and continuing to use our service, you are agreeing to all of the AltusHost policies.
Please be aware that these policies may change at anytime without advanced notice, though we will notify you of changes. If you have any questions, comments, or concerns with any of our policies, please contact us. We are happy to explain the reasons for any of our policies.

AltusHost respects your privacy! Any information collected by us will be securely stored and kept strictly confidential. The information you supply us will not, under any circumstance, be sold, reused, rented, loaned, distributed, or otherwise disclosed to any third party. Any information you supply AltusHost will be held with the utmost care, and will not be used in ways that you have not consented to. A more detailed explanation of how we safeguard your personal information is described below. If you have any questions, please don't hesitate to let us know.

Resale or disclosure of information to third parties
AltusHost does not sell, rent, loan, trade, or lease any personal information collected at our site, this includes member details, e-mail addresses, and other personal information.

Browser information collected on the website
AltusHost analyzes our website logs to constantly improve the value of the materials available on website. Our website logs are not personally identifiable, and we make no attempt to link them with the individuals that actually browse the site.

Privacy of our e-mail lists
AltusHost maintains several e-mail lists to keep AltusHost members informed about breaking events. We do not sell, rent, loan, trade, or lease the addresses on our list to anyone. In addition, our list server configuration software to refuse to divulge the e-mail addresses of our list subscribers to anyone but authorized AltusHost staff, including other list subscribers.

 

AltusHost Inc. (hereinafter referred to as "AltusHost") provides web hosting to people all around the world. We have the responsibility to protect each client and provide them with the best service possible. The following guidelines were designed to ensure that our services remain of the utmost quality. Please read very carefully before ordering and/or using AltusHost services.

 

AltusHost Service Agreement

The AltusHost Service Agreement is a separate agreement between AltusHost and all customers. Please make sure you are in agreement with the following points and conditions, as well as our service agreement (in its entirety) before signing up for or using AltusHost's services. Contact our sales department for any clarifications.

 

Services
AltusHost will provide Customer with what they signed up for within their order according to the fees indicated to the Customer before AltusHost billed Customer. Customer also understands that unless AltusHost is running a promotion, AltusHost will not discount their price or provide anything more or less than what the customer signed up for without Customer upgrading their plan by a AltusHost customer service representative.

 

Rejection of Services
AltusHost reserves the right to cancel, temporarily suspend or deny services to Customer at our desecration. If AltusHost feels that it is not of its best interest, or a liability to obtain a customer, AltusHost will take into consideration past history on both business levels and personal levels to determine if customer is a liability to the company. AltusHost will give notice of cancellation if AltusHost cancels Customers account, as well as temporary suspension and denied services.

 

Payment
AltusHost will invoice Customer 7 days in advance of their official due date of their account. Customer agrees that as long as account is active, customer will maintain a good standing balance with AltusHost, and will pay before or on the due date of invoice. Any setup fees associated with the opening of the Customers account, or future upgrades are one time fees; services ordered during initial signup with setup fees will be charged up front, as well as the Customers hosting services.
If Customer has not paid by the account due date, AltusHost will wait 5 before suspending the account. If Customers account is not paid after 10 days of the due date payment has not been received, AltusHost, at its descration, will terminate the customers service(s), unless arrangements have been made by the customer with AltusHost. Please note that Dedicated Servers Customers must pay all dues before or on due date, AltusHost will wait 1 day before suspending the account. If Customers account is not paid after 2 days of the due date payment has not been received, AltusHost, at its descration, will terminate the customers service(s), unless arrangements have been made by the customer with AltusHost.

 

System Resource Usage
If AltusHost's system administration team determines that a customer's account is utilizing an unacceptable amount of system resources, AltusHost may temporarily deactivate the account in question. If AltusHost's staff deems necessary, an eviction notice may be sent to the customer of an offending account providing them with 7 days in which to either upgrade to a vps/dedicated server or locate a new provider. This only occurs in extreme cases.
AltusHost will be the sole arbiter as to what constitutes a violation of this provision. Because of the nature of this provision, each account will be considered and analyzed individually.

 

Domain Parking Circumvention
Any attempt to circumvent domain parking restrictions by using selective HTTP redirects or any other method to send traffic from parked domains to sites other than the main site is strictly prohibited. If multiple domain names with separate content are required, domain pointers must be used instead.

 

Background Running Programs (bots/daemons/monitors)
Customers are not permitted to run programs in the background on shared hosting servers. This tends to use a lot of system resources, and can impair service to other customers on that server.

 

Backups
AltusHost's hosting accounts include a nightly backup service, however these backups are for AltusHost's administrative purposes only, and are in NO WAY GUARANTEED! Customers are responsible for maintaining their own backups on their own personal computers. AltusHost does not provide any sort of compensation for lost or incomplete data in the event that backups do not function properly (even if the malfunction was due to negligence on AltusHost's part). We will do our best to ensure complete and accurate backups, but assume no responsibility for this duty. Always back your site up to your personal computer! We make no guarantees about the availability of backups.


Content
All services provided by AltusHost may be used for lawful purposes only. Storage of any information, data or material in violation of any Belize law is prohibited. This includes, but is not limited to content related to: children pornography, phishing, scam, fraud, hacking material, viruses, malware, spyware.
Using AltusHost services for SPAM, MALWARE or BOTNETS are STRICTLY PROHIBITED! Services used for mentored activities will be suspended without warning!
The subscriber agrees to indemnify and hold harmless AltusHost from any claims resulting from the use of the service which damages the subscriber or any other party.

Staff Abuse
At AltusHost, we always treat our customers with the utmost respect. In return, we expect the same from you. If our staff feels that you are consistently addressing them in a demeaning or rude manner, your account may be suspended and you may be asked to take your business elsewhere. In the event that we terminate service for support abuse, customers will be given 7 days notice to find a new host. We will issue a refund only for the unused portion of pre-paid service.

 

Cron Jobs
We do allow Cron Jobs to be conducted on our servers. You can setup and manage the cron jobs for your account from the "Cron" section of Cpanel.

 

IRC (Internet Relay Chat)
We do not allow IRC or IRC bots to be operated on our servers. Any account found to be in violation of this provision will be immediately suspended and/or deactivated and no refund will be issued.

 

Shell Access
Shell access is provided on an as-needed basis. It does not come enabled on accounts by default. A request for this feature must be sent to technical support before it can be used. The request must include a domain name, username and explanation of why shell access is required. We reserve the right to refuse this service to any customer for any reason.

 

Unsolicited Email (SPAM)
SPAMing, or the sending of unsolicited email, from a AltusHost server or using a return email address that is maintained on a AltusHost server is STRICTLY prohibited. Using SPAM to advertise a site hosted on AltusHost's network also constitutes as a violation of this provision. AltusHost will be the sole arbiter as to what constitutes a violation of this provision. Sites found to be in violation of our SPAM policies will be immediately deactivated and no refund will be issued. Help us STOP SPAM! Please email our abuse department immediately to report a violation of our SPAM policies.

 

Server Abuse
Any attempts to undermine or cause harm to an AltusHost's server or customer of AltusHost is strictly prohibited. AltusHost will be the sole arbiter as to what constitutes a violation of this provision. Customers found in violation of this provision will be subject to account deactivation without refund. AltusHost will turn all available information about abuse incidents, including customer contact data, over to the proper authorities and press charges.

 

Failure to Follow Policies
Failure to fully comply with these terms is grounds for account suspension and/or deactivation (with or without refund, subject to AltusHost's discretion). Any accounts and/or servers contained within AltusHost's network must adhere to the above policies. We reserve the right to remove any account without prior notice. If we deactivate your account for violating policy, you will forfeit your rights to a refund--and none will be given. No refunds for advanced payment. Our normal policy is a warning first, and account deactivation the second offense, but no warning is required. AltusHost reserves the right to deactivate, suspend and remove any site hosted on our servers that contains any content that it deems in its sole discretion to be unacceptable, undesirable or contraindicated.

 

Cancellation of Services
To cancel account, the customer must login to their account, click on My Hosting Packages, click the service you wish to cancel, and click "Request Cancellation".  Cancellation by any other means will not be an acceptable form of a cancellation request.
If you are canceling under our Money Back Guarantee, please be sure to specify this in addition to your reason of cancellation.

 

Refund Policy
All new Shared & Reseller Hosting Accounts are covered by a 30 day money back guarantee. If you become dissatisfied with our services at any point within the first 30 days of holding an active account, we will issue a 100% refund of your money unless otherwise specified at, or prior to, the time of purchase.
Your web hosting account will renew on a monthly basis. Refunds for web hosting account renewals will be granted to customers who request a cancellation of their service, in writing, no later than 5 days after the renewal date. No exceptions will be made to this policy.
Accounts cancelled/terminated by AltusHost do not qualify for the 30 day money back guarantee. Only first-time accounts are eligible for a refund. For example, if you've had an account with us before, cancelled and signed up again, you will not be eligible for a refund or if you have opened a second account with us.
VPS customers can receive prorated refunds for there basic service, if requested within 7 days.
On Dedicated servers setup fees and the first month's fee are non-refundable.
All domain names sales are made final at the time of purchase. You are the sole owner of any domain names registered through our services upon payment in full. Should you decide to leave our service for another provider, domain names are transferable and therefore not subject to refunds.
Changes to registered domain names (incorrect spelling, etc..) cannot be made once the domain has been purchased with a domain registry. It is very important that you verify the spelling of your domain name and it is recommended that you have someone else read it as well to ensure it is exactly as expected.
Domain Name Renewals - Domain Name renewals are billed automatically on the schedule agreed to in the contract. They will renew automatically until you write in and cancel the renewal of you domain name. Keep in mind that domain names are on a minimum of an annual plan.

 

Liability
YOU AGREE THAT ALTUSHOST INC. WILL NOT BE LIABLE FOR ANY:
(1) USE OF YOUR WEB HOSTING ACCOUNT,
(2) INTERRUPTION OF BUSINESS,
(3) ACCESS DELAYS OR ACCESS INTERRUPTIONS TO OUR SITE OR THE WEB SITE(S) OR SERVICES YOU HAVE HOSTED ON OUR SERVER;
(4) LOSS OR LIABILITY RESULTING FROM ACTS OF GOD;
(5) DATA NON-DELIVERY, MIS-DELIVERY, CORRUPTION, DESTRUCTION OR OTHER MODIFICATION;
(6) EVENTS BEYOND OUR CONTROL;
(7) THE PROCESSING OF THIS APPLICATION;
(8) LOSS OR LIABILITY RESULTING FROM THE UNAUTHORIZED USE OR MISUSE OF YOUR ACCOUNT IDENTIFIER OR PASSWORD.
ALTUSHOST ALSO WILL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING LOST PROFITS) REGARDLESS OF THE FORM OF ACTION WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

General Refund Policy
Only first-time accounts are eligible for a refund. For example, if you've had an account with us before, cancelled and signed up again, you will not be eligible for a refund or if you have opened a second account with us. Refunds only apply to the money back guarantee.
There are no refunds on domain name registrations, dedicated servers, colocation services, service addons, software licenses, setup fees, administrative fees, account credit balance, support or install fees. Account renewals and recurring payments after the money back guarantee are non-refundable. We will not refund accounts that do not cancel before their next due date. Meaning, while canceling, your last payment made prior to canceling will not be refunded. Client may request a cancellation date that matches the service end date.

Services covered by Money Back Guarantee
All new Budget Web Hosting, Standard Web Hosting, Reseller Hosting Accounts are covered by 30 days Money Back Guarantee. If you become dissatisfied with our services at any point within the first 30 days of holding an active account, we will issue a full refund of your money unless otherwise specified at, or prior to, the time of purchase.
All new VPS Hosting customers can receive prorated refunds for basic service, if requested within 7 days.
Money back guarantee isn't valid for clients who violates any of our Service Policies. We have all rights to decline a refund when you are in violation.

Inappropriate E-Mail Activities:
Commercial e-mail: Defined as sending unsolicited commercial e-mails. This is prohibited. You are not permitted to use your AltusHost service to send unsolicited commercial e-mail. Using an e-mail address hosted anywhere on AltusHost servers to collect responses from unsolicited commercial e-mail is prohibited. This includes using a throw-away, free e-mail account to promote your AltusHost account and redirectors for the same account.
Mail Bombing: Defined as sending large volumes of unsolicited e-mail to individuals from your AltusHost service. This is strictly prohibited.
Harassment: Defined as sending threatening or harassing e-mail after being requested to stop, is prohibited. Extremely threatening or harassing e-mail never is allowed.

Inappropriate Newsgroup/Forums Activities:
Newsgroup/Forums Spamming: Defined as excessive cross-posting, or posting the same article to several Newsgroup/Forums. This is prohibited. Generally accepted standards allow no more than 15 newsgroups, or cross-postings, for a single article or substantially similar articles. Such articles may be canceled. You are not allowed to use your AltusHost based mail facilities to SPAM the Newsgroup/Forums.
Off topic or inappropriate postings: There is no restriction on content, except as defined by each Newsgroup/Forums. Continued posting of off-topic articles is prohibited. Please note that commercial advertisements are off-topic in the vast majority of Newsgroup/Forums.

Fine/Penalties:
Should you violate AltusHost's SPAM Policies, you WILL be charged $150 per hour for the time it takes us to "clean-up" your SPAM. This shall include but not be limited to the time required to answer e-mail from angry recipients of your SPAM and/or repair of a damaged server due to the "Mail Bombing" or other actions of the angry recipients in retaliation of your SPAM. You will also be charged $20 per gigabyte of data transfer that your SPAM incurred, including bandwidth used by answers to or complaints about your SPAM. We will invoice this amount and should it not be paid, we will take legal action against you.


We take a very dim view of SPAM. It is one of the most annoying things encountered on the Internet. Any AltusHost client found to be spamming will have his/her account terminated immediately - no questions asked (we will investigate the report thoroughly before terminating any account). There is no warning or second chance.


We are not attempting to censor, nor are we attempting to curtail the business of our customers. But as a whole, spamming hurts our members and us more than it helps the one spammer. Do yourself, and us, a favor: PLEASE DON'T DO IT.
